1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of rawvir.com and any purchase of products or subscription services offered by Nexora Commerce LLC, doing business as RawVir ("RawVir," "we," "our," or "us"). By accessing or using the Website, creating an account, or purchasing any Product, you represent that you are at least 18 years of age, have full legal capacity to enter into a binding agreement, and agree to be bound by these Terms in their entirety.

1.1 Electronic Assent

You will be required to take an affirmative action (such as checking a box or clicking a clearly labeled button) acknowledging agreement to these Terms before completing certain transactions. This constitutes legally binding electronic consent.

1.2 Modifications to Terms

We may revise these Terms at any time. If changes are material, we will provide reasonable notice. Continued use after changes become effective constitutes acceptance.

2. Website Use & Access

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Website solely for personal, non-commercial use. We reserve the right to modify, restrict, or terminate access at any time and for any reason.

3. Account Security

If you create an account, you must provide accurate and current information. You are responsible for maintaining the confidentiality of your login credentials and must notify us immediately at support@rawvir.com of any unauthorized access.

4. Prohibited Uses

  • Violate any applicable law or regulation
  • Scrape, crawl, or use automated means to access the Website
  • Interfere with Website security or functionality
  • Upload malicious code or viruses
  • Engage in fraudulent or deceptive conduct
  • Impersonate any person or entity
  • Attempt unauthorized access to systems or data
  • Infringe any intellectual property or privacy rights
  • Collect personal information of other users

5. Intellectual Property

All Website content — including text, images, trademarks, logos, software, and design elements — is owned by or licensed to Nexora Commerce LLC (d/b/a RawVir). You may not reproduce, distribute, modify, or exploit Website content without our prior written consent.

6. Products; FDA Disclaimer; No Medical Advice

Statements regarding our Products have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease. All information on the Website is for informational purposes only and does not constitute medical advice. Consult a qualified healthcare professional before beginning any supplement program. Individual results may vary.

7. Electronic Communications; Consent

By using the Website or making a purchase, you consent to receive electronic communications from us including order confirmations, shipping notifications, and marketing communications (if opted in). Electronic communications satisfy any legal requirement that such communications be in writing.

8. Privacy; Cookies & Tracking

All information we collect is subject to our Privacy Policy, incorporated into these Terms by reference. Our Website uses cookies, pixels, and similar tracking technologies.

9. Payments & Billing

9.1 Orders as Offers

An order submitted constitutes an offer to purchase Products. All orders are subject to acceptance by RawVir. We reserve the right to refuse or cancel any order at our discretion. Prices are listed in U.S. dollars and are subject to change without notice.

9.2 Payment Authorization

By providing a payment method, you represent that you are authorized to use it and that all payment information is accurate. You authorize Nexora Commerce LLC to charge your payment method for Products purchased, subscription renewals, shipping charges, applicable taxes, and any other disclosed fees.

9.3 Third-Party Payment Processors

Payments may be processed through third-party providers subject to their own terms and privacy policies. RawVir is not responsible for payment processor errors.

10. Shipping; Title; Risk of Loss

Products are shipped via third-party carriers to U.S. addresses. Accurate shipping information is required. Title and risk of loss transfer to you upon delivery to the carrier. Delivery dates are estimates only and cannot be guaranteed.

11. Delivery Confirmation

Carrier delivery confirmation shall be deemed conclusive proof of delivery to the address you provided, even without a signature. This constitutes sufficient evidence of delivery for dispute resolution purposes.

12. Returns & Refunds

Please review our Refund Policy for complete terms. Unless otherwise stated, all sales are final. Refunds where applicable are processed to the original payment method. Shipping and handling fees are non-refundable.

13. Subscriptions; Automatic Renewal; Cancellation

13.1 Subscription Enrollment

By enrolling in a subscription, you agree to recurring payment obligations and authorize Nexora Commerce LLC to charge your payment method automatically at the selected billing interval until cancelled.

13.2 Clear Disclosure; Affirmative Consent

Before completing enrollment, we will present a clear notice disclosing: (a) that your subscription will automatically renew; (b) the renewal period and amount; (c) available cancellation methods and a direct cancellation link; and (d) our contact information. You must take an affirmative action to confirm consent to recurring charges.

13.3 Automatic Renewal

Unless you cancel in accordance with these Terms, your subscription will automatically renew at the then-current rate and billing interval. If pricing changes, we will provide advance notice as required by law.

13.4 How to Cancel

Cancel at least 24 hours before your next billing date via:

  • Online: Log into rawvir.com/account and follow the cancellation steps. No phone call required.
  • Email: Send a request to support@rawvir.com. We will confirm within one (1) business day.

13.5 California Subscriber Rights

Your subscription will automatically renew unless cancelled before the next renewal date. If we fail to provide required disclosures prior to enrollment, we will provide a full refund of unauthorized charges. Contact support@rawvir.com to request a refund under this provision.

14. SMS / Mobile Messaging

By opting in, you consent to receive recurring automated marketing and transactional text messages from RawVir at the number provided. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out. Reply HELP for support.

15. User Content; Reviews & Submissions

By submitting reviews, testimonials, or other content, you grant Nexora Commerce LLC a perpetual, worldwide, royalty-free license to use, reproduce, modify, and publicly display such content for business purposes. You represent the content is truthful and does not violate third-party rights.

16. Disclaimer of Warranties

The Website, Products, and all content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Nexora Commerce LLC disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the maximum extent permitted by law, in no event shall Nexora Commerce LLC or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to these Terms or your use of the Website or Products.

17.1 Cap on Direct Damages

Nexora Commerce LLC's total liability for any claim shall not exceed the greater of: (a) the total amount you paid to RawVir during the twelve (12) months preceding the event giving rise to the claim; or (b) one hundred U.S. dollars ($100.00).

18. Indemnification

You agree to defend, indemnify, and hold harmless Nexora Commerce LLC and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses arising out of or relating to your violation of these Terms, misuse of the Website or Products, or violation of any law or third-party rights.

19. Limitation on Time to File Claims

Any claim arising out of or relating to these Terms, the Website, or any Product must be commenced within one (1) year after the claim accrues. Claims not commenced within that period are permanently barred.

20. Dispute Resolution; Binding Arbitration

20.1 Agreement to Arbitrate

You and Nexora Commerce LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Website, any Product, or any subscription shall be resolved exclusively through binding, confidential arbitration on an individual basis.

20.2 Federal Arbitration Act

These Terms evidence a transaction in interstate commerce. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs all proceedings under this arbitration agreement.

20.3 Class Action Waiver

You and Nexora Commerce LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

20.4 Governing Law & Venue

These Terms shall be governed by the laws of the State of California. Any dispute not subject to arbitration shall be resolved in the state or federal courts of Los Angeles County, California.
